    Terms of Use

    Welcome to Bookfolks, an application developed and maintained by MICHEL FELIPE DE SENA NASSIF LTDA (“we,” “us,” or “our”). By downloading or using the Application (“the App”), you agree to comply with the following terms:

    1. Eligibility and Your Account

    You must be at least 16 years old to use the App. By creating an account, you confirm that you meet this requirement, that the information you provide is accurate, and that you will keep your login credentials secure. You are responsible for all activity that occurs under your account.

    2. Intellectual Property and Usage Restrictions

    The App, its design, trademarks, and all related intellectual property are owned by us. You agree not to:

    • Copy, modify, or create derivative works based on the App;
    • Reverse engineer or extract the App’s source code;
    • Misuse our trademarks, copyrights, or database rights.

    All rights not expressly granted under these Terms remain reserved.

    3. Updates and Modifications

    We are committed to providing a beneficial and efficient App. Therefore, we reserve the right to:

    • Update or modify the App’s features at any time;
    • Introduce charges for services, with prior notice provided.

    4. Community and User-Generated Content

    The App includes social features such as profiles, discussion posts (including images), likes, comments, and following other readers.

    Your content: You retain ownership of the content you post. By posting, you grant us a worldwide, non-exclusive, royalty-free license to host, store, display, and distribute that content within the App and its services, solely for the purpose of operating and promoting the App’s features. This license ends when you delete your content or your account, except where retention is required by law.

    Community rules: You agree to engage respectfully and not to post content that:

    • Contains hate speech, harassment, threats, or bullying;
    • Is illegal, obscene, or sexually explicit;
    • Infringes someone else’s intellectual property or privacy;
    • Impersonates another person or entity;
    • Is spam, misleading, or deceptive.

    Please use the spoiler options when discussing plot details.

    Moderation: We may, but are not obligated to, review, moderate, or remove content. We may issue warnings, restrict access to community features, or suspend or terminate accounts that violate these rules. You can report profiles within the App or by contacting us. To report content that you believe is illegal or infringes your rights (including copyright), email us at michel.nassif@bookfolks.io with a description of the content and where it appears; we will review such reports and remove content where appropriate. You are fully responsible for the content you post.

    5. Subscriptions and Payments

    Some features of the App are available through paid subscriptions:

    • Subscriptions are billed in advance on a recurring basis (monthly or annually, as selected) through your app store account;
    • You are responsible for ensuring that your payment method remains valid. Failure to process payment may result in suspension or cancellation of your subscription;
    • Your subscription renews automatically unless canceled at least 24 hours before the renewal date through your app store account settings;
    • Refunds are handled in accordance with the policies of the app store through which the subscription was purchased. We do not provide direct refunds, except where required by applicable law;
    • We reserve the right to adjust subscription pricing. Any price changes will be communicated in advance and will not affect your current billing cycle.

    6. Data Collection and Privacy

    The App collects user data to provide its services. Please refer to our Privacy Policy for details about data collection, use, and security measures, including your privacy rights under laws such as the GDPR, LGPD, and CCPA/CPRA.

    7. Third-Party Services

    The App integrates third-party services with their respective Terms of Use and Privacy Policies, including:

    • Google Play Services
    • Google Analytics for Firebase
    • Firebase Crashlytics
    • OneSignal
    • RevenueCat
    • Meta (Facebook App Events)
    • Google Sign-In and Apple Sign-In

    8. Device and Internet Responsibility

    You are responsible for maintaining an active internet connection and ensuring your device’s functionality. We are not liable for issues arising from your device’s condition, lack of internet access, or data usage charges imposed by your carrier.

    9. Account Suspension, Termination, and Deletion

    You may stop using the App at any time and may request deletion of your account through the App settings (“Delete my account”) or by emailing michel.nassif@bookfolks.io. We may suspend or terminate your account if you violate these Terms, with notice where required by applicable law.

    10. Updates, Termination, and End of Service

    We may update the App to improve features or maintain compatibility. We also reserve the right to suspend or permanently discontinue the App (“End of Service”) at our sole discretion.

    • In the event of End of Service, active subscriptions will be canceled, and access to paid features will cease;
    • You will not be entitled to refunds for partial subscription periods unless otherwise required by applicable law or app store policies;
    • Upon termination, you must delete the App from your device.

    11. Disclaimer of Warranties and Limitation of Liability

    The App is provided on an “as is” and “as available” basis, without warranties of any kind, express or implied. We do not guarantee that the App will be error-free, uninterrupted, secure, or free of harmful components.

    To the maximum extent permitted by law, we disclaim all liability for any damages, including but not limited to indirect, incidental, special, consequential, or punitive damages, arising from your use of the App.

    Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain damages. In those jurisdictions, these exclusions and limitations apply only to the extent permitted by law, and nothing in these Terms limits your mandatory rights as a consumer.

    12. Governing Law and Disputes

    These Terms are governed by the laws of the Federative Republic of Brazil. If you are a consumer residing in another country, you also benefit from any mandatory consumer protection provisions of the law of your country of residence, and you may bring proceedings in your local courts where the law entitles you to do so.

    13. Apple App Store

    If you access the App on an Apple device, you acknowledge that these Terms are an agreement between you and us, not with Apple Inc. Apple is not responsible for the App or its content and has no obligation to provide any maintenance, support, or warranty services for the App. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

    14. General Provisions

    If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect. These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the App.

    15. Changes to Terms of Use

    We may update these Terms of Use periodically. Notifications about updates will be made available within the App. Continued use of the App after changes indicates your acceptance of the revised Terms.
